Statement of Purpose

The purpose of  the Register of  Deeds office is to record, preserve, and maintain all the records pertaining to real estate in Atchison County, Kansas.  These documents include, but are not limited to, deeds, affidavits, mortgages, mortgage assignments and releases, easements, plats, surveys, and military records.  All records in this office are open to the public, in compliance with the Kansas Open Records Act.  Atchison County records began in 1855.

Basic Requirements for Filing

The document must be signed and notarized and have original signatures, both of  the grantor(s) and the notary.  The notary must use a stamp or a seal.  If a raised seal is used, then the notary’s name must be printed or typed below the signature.  The name(s) of  the grantor(s) must be printed or typed below the signature.  Failure to do this may result in an additional fee of $1.00 per signature. Certified photocopies of documents may be accepted, but only if they are certified by another recording office.

The filing fee is set by statute and must be paid at the time of filing.  Generally, the filing fee is based upon the number of  pages the document contains.   Mortgages have a tax which is also paid at the time of filing.  To determine the amount of the registration tax, multiply the amount of indebtedness by .0026.  This tax is in addition to the regular filing fee.
